What Exactly Is An Environmental Site Assessment (ESA)?
In the United States, an environmental site assessment is a professional report prepared for a property or real estate holding that identifies potential or existing environmental contamination liabilities. This environmental site analysis, often abbreviated as an ESA, typically addresses both the underlying land as well as physical improvements to the property.
The main intent of a Phase 1 ESA (environmental site assessment) report is to assess if current or historical property uses have impacted the soil or groundwater beneath the property and could pose a threat to the environment and/or human health. If these environmental issues and threats are found, it presents a potential liability for the lender and/or owner of the property, as well as affecting the value of the land.
A Phase I ESA completed prior to the closure of a real estate transaction can be used to meet the requirements of CERCLA’s (Comprehensive Environmental Response, Compensation and Liability Act) innocent landowner defense under All Appropriate Inquiries (AAI).
